Spain's Prosecutor's Office says human rights violations in Gaza will be investigated

MADRID, September 18, 2025 (WAFA) – The Spanish Public Prosecutor's Office announced on Thursday that Madrid will investigate human rights violations in Gaza as part of its cooperation with the International Criminal Court (ICC).

In a statement, the State Attorney General said that the office issued a decree establishing a working group to investigate violations of international human rights law in Gaza, with the aim of collecting evidence and making it available to the competent authorities, thus respecting Spain's obligations regarding international cooperation and human rights.

The statement added that this initiative by the Spanish Public Prosecutor's Office comes in response to the recommendations of the report of the Independent International Commission of Inquiry on the Palestinian Territories, mandated by the United Nations, which urges state parties to cooperate with the investigation conducted by the Office of the Prosecutor of the International Criminal Court.

According to the decree of the Spanish Public Prosecutor's Office, Madrid is "obligated to provide the necessary cooperation and assistance" to the investigation, "which legitimizes the opening of an investigation within the scope of the Office of the Prosecutor's mandate, in order to make the principle of international cooperation real and effective."

The decree added: "Given the current situation in the Palestinian territories, any evidence, direct or indirect, that may be collected in our country must be incorporated into a procedural framework that allows for its subsequent use."

According to the Prosecutor, collective evidence can serve as evidence against crimes committed.

In 2024, the International Criminal Court issued arrest warrants against Israeli Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant for war crimes and crimes against humanity.

Spain is among the countries that have joined the proceedings initiated by South Africa before the International Court of Justice, which accuses Israel of committing genocide in the Gaza Strip.
